{"id":9094,"date":"2020-01-17T07:49:35","date_gmt":"2020-01-17T06:49:35","guid":{"rendered":"https:\/\/ipisresearch.be\/\/?post_type=publication&#038;p=9094"},"modified":"2020-06-07T14:27:19","modified_gmt":"2020-06-07T12:27:19","slug":"arms-trade-bulletin-november-december-2019","status":"publish","type":"weekly-briefing","link":"https:\/\/ipisresearch.be\/nl\/weekly-briefing\/arms-trade-bulletin-november-december-2019\/","title":{"rendered":"Arms Trade Bulletin November \u2013 December 2019"},"content":{"rendered":"<h1><span style=\"font-family: 'times new roman', times, serif;\">THE CASE FOR ON-SITE INSPECTIONS<\/span><\/h1>\n<p align=\"JUSTIFY\">South Africa has decided to block arms exports to Saudi Arabia, United Arab Emirates, Oman and Algeria after these countries refused to allow South African officials to inspect their facilities to verify compliance with the South African National Conventional Arms Control Act and South African National Conventional Arms Control Regulations. The clause in the end-use certificate which caused this dispute states the following: \u201cThe Consignee\/Buyer grants access and permission to South African Government Authority\u2019s representative(s) to visit the stated facilities so as to verify the end user and end use of and compliance with the above stated stipulations\u201d. The on-site inspections are allegedly refused by Saudi Arabia and UAE on the ground that these inspections are considered a violation of their sovereignty.<\/p>\n<p align=\"JUSTIFY\">But when these countries procure defence equipment from the United States they also have to allow on-site inspections. The United States maintains three end-use monitoring programs by law: the Department of State&#8217;s Blue Lantern (for Direct Commercial Sales), the Department of Defense&#8217;s Golden Sentry (for Foreign Military Sales), and the program by the Department of Commerce (for dual-use items). These programs may include on-site inspections on a case by case basis. The <span style=\"color: #000080;\"><span lang=\"zxx\"><u><a href=\"https:\/\/www.army.mil\/article\/192447\/end_use_monitoring_is_the_key_to_success_in_foreign_military_sales\">Golden Sentry program<\/a><\/u><\/span><\/span> includes Routine End Use Monitoring and Enhanced End Use Monitoring. The EEUM is used for highly sensitive defence equipment like for instance Stinger missiles, anti-tank missiles, and night-vision equipment. The EEUM designated equipment inventory of the recipient is verified by serial number on an annual basis through planned and coordinated visits. It should be noted that the Wassenaar Arrangement on Export Controls for Conventional Arms and Dual-Use Goods and Technologies recommends that the end-use\/user certificate <span style=\"color: #000080;\"><span lang=\"zxx\"><u><a href=\"https:\/\/ipisresearch.be\/\/publication\/study-development-framework-improving-end-use-end-user-control-systems\/\">includes an agreement<\/a><\/u><\/span><\/span> by the importer\/end user to allow on-site verification. South Africa is a Party to the Wassenaar Arrangement.<\/p>\n<p align=\"JUSTIFY\">That the South African government is weary for diversion by Saudi Arabia and the UAE of the supplied weapons is not without cause. In <span style=\"color: #000080;\"><span lang=\"zxx\"><u><a href=\"https:\/\/www.dw.com\/en\/uae-siphoning-western-arms-to-yemen-militias-accused-of-war-crimes-amnesty\/a-47377346\">February 2019<\/a><\/u><\/span><\/span> Amnesty International accused the UAE to have supplied Yemeni militia with Western arms. While CNN accused <span style=\"color: #000080;\"><span lang=\"zxx\"><u><a href=\"https:\/\/edition.cnn.com\/interactive\/2019\/02\/middleeast\/yemen-lost-us-arms\/\">Saudi Arabia and UAE<\/a><\/u><\/span><\/span> of having armed al Qaeda and Salafi militias with American made weapons. In a follow-up report published in <span style=\"color: #000080;\"><span lang=\"zxx\"><u><a href=\"https:\/\/edition.cnn.com\/2019\/10\/18\/world\/american-weapons-yemen-war-intl\/index.html\">October CNN<\/a><\/u><\/span><\/span> again accused the UAE of having armed Yemeni militia with American military equipment. In November Al Jazeera reported to have seen a draft report of the UN Panel of Experts on Libya. In their report, published on <span style=\"color: #000080;\"><span lang=\"zxx\"><u><a href=\"https:\/\/undocs.org\/S\/2019\/914\">6 December<\/a><\/u><\/span><\/span> (S\/2019\/914), the Panel of Experts found that Jordan, the United Arab Emirates and the Haftar Affiliated Forces were in repeated non-compliance with the UN arms embargo imposed upon Libya. The <span style=\"color: #000080;\"><span lang=\"zxx\"><u><a href=\"https:\/\/www.nytimes.com\/2019\/06\/28\/world\/africa\/libya-american-missiles.html\">New York Times<\/a><\/u><\/span><\/span> reported that US-made anti-tank missiles were found in the possession of Haftar Affiliated Forces, which were sold to the UAE in 2008. Also Turkey and the internationally-recognised Government of National Accord were found to be in non-compliance with the UN arms embargo. The Panel of Experts reported that \u201cin response to the illicit transfers by Jordan and the United Arab Emirates, GNA approached Turkey, who soon supplied GNA-AF with military materiel\u201d. The UAE also stands accused of having broken the UN arms embargo against Somalia (S\/2017\/924, S\/2018\/1002, and S\/2019\/858).<\/p>\n<p align=\"JUSTIFY\">Meanwhile one of South Africa&#8217;s trade unions, Solidarity, objects against the inclusion of said clause in the end-user certificates claiming that jobs might be at risk. In a <span style=\"color: #000080;\"><span lang=\"zxx\"><u><a href=\"https:\/\/solidariteit.co.za\/en\/regulations-can-destroy-arms-industry-and-lead-to-job-losses\/\">press statement<\/a><\/u><\/span><\/span> it is said: \u201cSeveral legal opinions indicate that the inspections clause of the end-user certificate is illegal and obstructive in nature and is in fact not contained in the NCACA itself, but only in the wording of the certificate.\u201d It should be noted that the National Conventional Arms Control Act 2002 makes provision for the \u201cMinister may make regulations\u2026 regarding\u2026 matters which must be contained in an end-user certificate\u201d.
