{"id":9010,"date":"2019-11-22T11:11:32","date_gmt":"2019-11-22T10:11:32","guid":{"rendered":"https:\/\/ipisresearch.be\/\/?post_type=publication&#038;p=9010"},"modified":"2020-06-07T14:27:20","modified_gmt":"2020-06-07T12:27:20","slug":"arms-trade-bulletin-september-october-2019","status":"publish","type":"weekly-briefing","link":"https:\/\/ipisresearch.be\/nl\/weekly-briefing\/arms-trade-bulletin-september-october-2019\/","title":{"rendered":"Arms Trade Bulletin September &#8211; October 2019"},"content":{"rendered":"<div id=\"sdfootnote28\">\n<h1>EDITORIAL<\/h1>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif;\"><u><b>&#8220;The Kurds &#8216;didn&#8217;t help us&#8217; in <\/b><\/u><a class=\"western\" href=\"https:\/\/www.youtube.com\/watch?v=RHkd4t8or9w\"><span style=\"color: #6666ff;\"><u><b>Normandy&#8221;<\/b><\/u><\/span><\/a><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif;\">On 8 October the <a class=\"western\" href=\"https:\/\/twitter.com\/SecPompeo\/status\/1181377762344554498\"><span style=\"color: #6666ff;\">invasion<\/span><\/a> of northern Syria by Turkey began with air strikes on the positions of the Syrian Democratic Forces (SDF). This military offensive came after a <a class=\"western\" href=\"https:\/\/www.whitehouse.gov\/briefings-statements\/statement-press-secretary-85\/\"><span style=\"color: #6666ff;\">telephone call<\/span><\/a> between president Trump and president Erdogan on 6 October. Trump had agreed to withdraw U.S. troops from northern Syria. The U.S. media speculate that Trump&#8217;s willingness to please president Erdogan is due to the ongoing business interests of the <a class=\"western\" href=\"https:\/\/www.nbcnews.com\/politics\/trump-impeachment-inquiry\/donald-trump-s-longtime-business-connections-turkey-back-spotlight-n1064011\"><span style=\"color: #6666ff;\">Trump family in Turkey<\/span><\/a>. It is alleged that the Trump family still has <a class=\"western\" href=\"https:\/\/www.aljazeera.com\/indepth\/opinion\/trump-foreign-policy-follow-money-171118145504969.html\"><span style=\"color: #6666ff;\">business interests<\/span><\/a> in Saudi Arabia and the UAE.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif;\">The SDF is a <a class=\"western\" href=\"https:\/\/www.aljazeera.com\/news\/2019\/10\/syrian-democratic-forces-191015080247945.html\"><span style=\"color: #6666ff;\">military alliance<\/span><\/a> of Arab, Turkmen, Armenian and Syrian Kurdish fighters. The Kurdish People&#8217;s Protection Units (YPG) are the leading force within the SDF, and are considered terrorists by Turkey. The Turkish invasion is supported by armed Syrian opposition groups linked to the former Free Syrian Army (FSA). These <a class=\"western\" href=\"https:\/\/www.voanews.com\/extremism-watch\/which-syrian-groups-are-involved-turkeys-syria-offensive\"><span style=\"color: #6666ff;\">Turkish-backed proxies<\/span><\/a> call themselves the Syrian National Army (SNA), which includes radical islamist, and salafist jihadi armed groups. Already in 2013 the Pentagon had estimated that more than half of the FSA (then backed by the United States) was composed of <a class=\"western\" href=\"https:\/\/foreignpolicy.com\/2019\/10\/14\/turkish-backed-forces-freeing-islamic-state-prisoners-syria\/\"><span style=\"color: #6666ff;\">extreme islamist<\/span><\/a> groups. In March 2018 Turkish armed forces and its proxies have committed serious <a class=\"western\" href=\"https:\/\/www.amnesty.org\/en\/latest\/news\/2018\/08\/syria-turkey-must-stop-serious-violations-by-allied-groups-and-its-own-forces-in-afrin\/\"><span style=\"color: #6666ff;\">human rights violations<\/span><\/a> after the capture of Afrin from YPG forces, including arbitrary detention, enforced disappearances, and torture. A few days after the invasion of northern Syria the first news reports of extrajudicial killings of civilians and prisoners of war by the SNA have emerged. (*) On October 13 U.S. Defense Secretary <a class=\"western\" href=\"https:\/\/thehill.com\/homenews\/sunday-talk-shows\/465564-esper-turkey-appears-to-be-committing-war-crimes-in-northern-syria#\"><span style=\"color: #6666ff;\">Mark Esper<\/span><\/a> accused Turkey of committing war crimes in northern Syria. The UN High Commissioner for Human Rights released a press statement which stated: \u201cUnder international human rights and international humanitarian law, summary executions are serious violations \u2013 and may amount to a war crime. Turkey could be deemed <a class=\"western\" href=\"https:\/\/www.ohchr.org\/EN\/NewsEvents\/Pages\/DisplayNews.aspx?NewsID=25145&amp;LangID=E\"><span style=\"color: #6666ff;\">responsible<\/span><\/a> as a State for violations committed by their affiliated armed groups, as long as Turkey exercises effective control over these groups, or the operations in the course of which those violations occurred.\u201d<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif;\">The Turkish objective allegedly was to create a 30km deep &#8216;safe zone&#8217; along the Turkish-Syrian border. Turkish president Erdogan plans to send millions of Arab Syrian refugees into northern Syria. The international community fears mass displacement of the Syrian Kurds. Some warned that this may lead to <a class=\"western\" href=\"https:\/\/nationalinterest.org\/blog\/middle-east-watch\/cost-trump%E2%80%99s-syria-decision-ethnic-cleansing-88246\"><span style=\"color: #6666ff;\">ethnic cleansing<\/span><\/a> of the Syrian Kurds, christians and other minorities. Newsweek reported that Fox News was told that <a class=\"western\" href=\"https:\/\/www.newsweek.com\/fox-news-reporter-says-trump-went-off-script-during-turkey-call-essentially-greenlighted-1464252\"><span style=\"color: #6666ff;\">U.S. military commanders had warned<\/span><\/a>Trump and the White House that their decision to pull the troops &#8220;could lead to the ethnic cleansing of the Kurdish fighters, who fought along U.S. forces to defeat ISIS&#8221;.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif;\">The Turkish government has been accused of arming and assisting islamist armed Syrian groups. In 2015 the Turkish newspaper \u2018Cumhuriyet\u2019 published photographs and video footage of trucks allegedly under the control of the <a class=\"western\" href=\"https:\/\/ipisresearch.be\/\/publication\/arms-trade-highlights-june-july-2015\/\"><span style=\"color: #6666ff;\">Turkish Intelligence Service (MIT) carrying weapons<\/span><\/a> destined for jihadis in neighbouring Syria. It is alleged that Turkey has turned a blind-eye to islamist jihadis crossing the Turkish-Syrian border. Brett McGurk, the former Presidential Envoy to the International Coalition to Defeat Daesh, had this to say on <a class=\"western\" href=\"https:\/\/twitter.com\/brett_mcgurk\/status\/1181956885303267328\"><span style=\"color: #6666ff;\">Twitter<\/span><\/a>: \u201cTal Abyad, a Syrian border town, was the main supply route for ISIS from 6\/14-6\/15 when weapons, explosives, and fighters flowed freely from Turkey to Raqqa and into Iraq. Turkey refused repeated and detailed requests to seal its side of the border with US help and assistance.\u201d McGurk acknowledged that some of the Turkish-backed opposition groups, who had received <a class=\"western\" href=\"https:\/\/twitter.com\/brett_mcgurk\/status\/1181956889367629824\"><span style=\"color: #6666ff;\">military aid<\/span><\/a> from the U.S., had previously given their military equipment to al-Qaeda in Syria.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif;\">It seems Trump&#8217;s decision did take Congress and Pentagon by surprise. Within Congress both Democrats and Republicans lambasted Trump for abandoning an ally. Republican Senator Lindsey Graham called for <a class=\"western\" href=\"https:\/\/www.thedrive.com\/the-war-zone\/30305\/top-senator-and-trump-ally-pushes-for-arms-embargo-on-turkey-after-syria-invasion-begins\"><span style=\"color: #6666ff;\">economic sanctions<\/span><\/a>, including an arms embargo, against Turkey. On Monday October 14 the U.S. Department of the Treasury\u2019s <a class=\"western\" href=\"https:\/\/home.treasury.gov\/news\/press-releases\/sm792\"><span style=\"color: #6666ff;\">Office of Foreign Assets Control<\/span><\/a> (OFAC) took action against two ministries and three senior Turkish Government officials in response to Turkey\u2019s military operations in Syria. An <a class=\"western\" href=\"https:\/\/www.consilium.europa.eu\/en\/press\/press-releases\/2019\/10\/14\/council-conclusions-on-north-east-syria\/\"><span style=\"color: #6666ff;\">EU arms embargo<\/span><\/a> against Turkey seems to have been <a class=\"western\" href=\"https:\/\/www.politico.eu\/article\/eu-finds-agreement-on-turkey-but-only-just-bloc-foreign-ministers-incursion-north-syria\/\"><span style=\"color: #6666ff;\">blocked<\/span><\/a> by the United Kingdom. Several <a class=\"western\" href=\"https:\/\/www.jpost.com\/Breaking-News\/Czech-Republic-halts-arms-exports-licenses-to-Turkey-interior-minister-604614\"><span style=\"color: #6666ff;\">EU member States<\/span><\/a> did impose an <a class=\"western\" href=\"http:\/\/bianet.org\/english\/militarism\/214406-which-countries-have-stopped-arms-export-to-turkey-after-syria-operation\"><span style=\"color: #6666ff;\">arms embargo<\/span><\/a> on Turkey: Germany, France, Finland, Sweden, Norway, Flanders, Netherlands, Italy, Czech Republic, possibly Spain and Denmark will follow.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif;\">On Monday October 14 it was reported that the SDF had <a class=\"western\" href=\"https:\/\/www.reuters.com\/article\/us-syria-security-turkey-kurds-deal\/syrian-kurdish-leaders-damascus-deal-to-protect-border-politics-later-idUSKBN1WT0LN\"><span style=\"color: #6666ff;\">accepted a deal<\/span><\/a>, brokered by the Russian government, with the Syrian government. Subsequently the Syrian armed forces rushed to the Syrian-Turkish border, and entered the town of Manbij on Tuesday. Russian forces are reported to have begun <a class=\"western\" href=\"https:\/\/www.theguardian.com\/world\/2019\/oct\/15\/russian-troops-patrol-between-turkish-and-syrian-forces-on-border\"><span style=\"color: #6666ff;\">patrolling the territory<\/span><\/a> separating Turkish-backed proxies from the Syrian army.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif;\">The winner of this debacle will most likely be ISIS. U.S. Defense Secretary Esper said the Turkish military invasion would encourage instability and could cause the <a class=\"western\" href=\"https:\/\/www.defense.gov\/Newsroom\/Transcripts\/Transcript\/Article\/1988194\/department-of-defense-press-briefing-by-secretary-esper-and-general-milley-in-t\/\"><span style=\"color: #6666ff;\">resurrection of ISIS<\/span><\/a>.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif;\">U.S. officials confirmed to <i>Foreign Policy<\/i> that Turkish-backed armed groups were \u201c<a class=\"western\" href=\"https:\/\/foreignpolicy.com\/2019\/10\/14\/turkish-backed-forces-freeing-islamic-state-prisoners-syria\/\"><span style=\"color: #6666ff;\">deliberately releasing detainees<\/span><\/a>affiliated with the Islamic State from unguarded prisons\u201d. Meanwhile ISIS militants have escaped from SDF captivity.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif;\">Claus Kre\u00df, professor of criminal law and public international law, argues that it is impossible to see how the Turkish invasion of northern Syria could be justified under international law based upon the right of self-defence. Moreover, \u201c[T]here is the very serious possibility that Operation \u2018Peace Spring\u2019 could constitute a <a class=\"western\" href=\"http:\/\/www.ejiltalk.org\/a-collective-failure-to-prevent-turkeys-operation-peace-spring-and-natos-silence-on-international-law\/\">manifest violation of the prohibition of the use of force<\/a>. There is reason to believe that the Turkish President, by giving and maintaining the order for \u2018Peace Spring\u2019, could have incurred and could continue incurring individual criminal responsibility for a crime of aggression, as defined in Article 8bis of the Statute of the International Criminal Court.\u201d<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif;\">Kre\u00df poignantly remarked: \u201c<span lang=\"en-US\">Turkey\u2019s NATO partners did not ask her to explain to the international community in a verifiable manner how the massive use of force she was announcing could be justified in view of the prohibition of the use of force under international law.
