{"id":16922,"date":"2020-09-11T10:22:56","date_gmt":"2020-09-11T08:22:56","guid":{"rendered":"https:\/\/ipisresearch.be\/\/?post_type=weekly-briefing&#038;p=16922"},"modified":"2020-09-21T17:37:20","modified_gmt":"2020-09-21T15:37:20","slug":"arms-trade-bulletin-july-august-2020","status":"publish","type":"weekly-briefing","link":"https:\/\/ipisresearch.be\/nl\/weekly-briefing\/arms-trade-bulletin-july-august-2020\/","title":{"rendered":"Arms Trade Bulletin July \u2013 August 2020"},"content":{"rendered":"<h1><span style=\"color: #000000; font-size: 24pt;\"><span style=\"font-family: Georgia, serif;\"><b>Pompeo covers up US failure to address Yemen civilian casualties from US munitions exports<\/b><\/span><\/span><\/h1>\n<p align=\"JUSTIFY\"><span style=\"font-family: Georgia, serif;\">On the 11<\/span><sup><span style=\"font-family: Georgia, serif;\">th<\/span><\/sup><span style=\"font-family: Georgia, serif;\"> August 2020 the Department of State Office of Inspector General (OIG) released its <\/span><span style=\"color: #000080;\"><span lang=\"zxx\"><u><a class=\"western\" href=\"https:\/\/www.stateoig.gov\/reports\/10715\"><span style=\"font-family: Georgia, serif;\">report on the investigation<\/span><\/a><\/u><\/span><\/span><span style=\"font-family: Georgia, serif;\"> into Secretary Pompeo\u2019s 24 mei 2019 emergency determination made under the Arms Export Control Act for the sale or transfer of over $8.1 billion in defence articles and services to the Kingdom of Saudi Arabia, the United Arab Emirates (UAE), and Jordan. According to the Chairman of the House Foreign Affairs Committee the Department of State had insisted that the OIG could only release a redacted version of the report. An <\/span><span style=\"color: #000080;\"><span lang=\"zxx\"><u><a class=\"western\" href=\"https:\/\/www.politico.com\/f\/?id=00000173-df44-d479-af73-ff5e7dd00000\"><span style=\"font-family: Georgia, serif;\">unredacted version<\/span><\/a><\/u><\/span><\/span><span style=\"font-family: Georgia, serif;\"> was leaked to Politico.<\/span><\/p>\n<p align=\"JUSTIFY\"><span style=\"font-family: Georgia, serif;\">In its report the OIG pointed out that the Saudi-led air campaign has attracted international criticism because of the continued high rates of civilian casualties. The September 2020 report of the United Nations Group of Eminent International and Regional Experts on Yemen concluded \u201cthat the parties to the conflict continue to show no regard for international law or the lives, dignity, and rights of people in Yemen, while third states have helped to perpetuate the conflict by continuing to supply the parties with weapons\u201d (A\/HRC\/45\/6). (See also the legal opinion by <\/span><span style=\"color: #000080;\"><span lang=\"zxx\"><u><a class=\"western\" href=\"https:\/\/ipisresearch.be\/\/publication\/opinion-legality-arms-transfers-saudi-arabia-united-arab-emirates-members-coalition-militarily-involved-yemen\"><span style=\"font-family: Georgia, serif;\">E. David, D. Turp, B. Wood, et al<\/span><\/a><\/u><\/span><\/span><span style=\"font-family: Georgia, serif;\">.) The OIG assert that some of the precision-guided munitions \u201c<\/span><span style=\"font-family: Georgia, serif;\"><i>used in each of these airstrikes may have been manufactured by U.S. defense firms<\/i><\/span><span style=\"font-family: Georgia, serif;\">\u201d and thus \u201c<\/span><span style=\"font-family: Georgia, serif;\"><i>subject to the Department\u2019s arms transfer review process<\/i><\/span><span style=\"font-family: Georgia, serif;\">\u201d<\/span> <span style=\"font-family: Georgia, serif;\"><span style=\"font-size: medium;\">(1)<\/span><\/span><span style=\"font-family: Georgia, serif;\">. The OIG concluded \u201c<\/span><span style=\"font-family: Georgia, serif;\"><i>that the Department did not fully assess risks and implement mitigation measures to reduce civilian casualties and legal concerns associated with the transfer of precision-guided munitions included in the May 2019 emergency certification<\/i><\/span><span style=\"font-family: Georgia, serif;\">\u201d.<\/span><\/p>\n<p align=\"JUSTIFY\"><span style=\"font-family: Georgia, serif;\">The OIG&#8217;s assessment is contained in a heavily-redacted secret annex of the report to Congress. In the cover letter of the report the acting Inspector General informed Congress that the Department of State \u201c<\/span><span style=\"font-family: Georgia, serif;\"><i>withheld significant information in the classified annex necessary to understand OIG\u2019s finding and recommendation<\/i><\/span><span style=\"font-family: Georgia, serif;\">\u201d in relation to the Department of State&#8217;s failure to minimize civilian casualties. The acting Inspector General continued by stating that the Department of State \u201c<\/span><span style=\"font-family: Georgia, serif;\"><i>asserted that the redactions made to the classified annex <\/i><\/span><span style=\"color: #000080;\"><span lang=\"zxx\"><u><a class=\"western\" href=\"https:\/\/www.stateoig.gov\/reports\/10715\"><span style=\"font-family: Georgia, serif;\"><i><b>should be withheld from Congress<\/b><\/i><\/span><\/a><\/u><\/span><\/span><span style=\"font-family: Georgia, serif;\"><i> because the underlying information implicates &#8216;executive branch confidentiality interests, including executive privilege&#8217;<\/i><\/span><span style=\"font-family: Georgia, serif;\">\u201d.<\/span><\/p>\n<p align=\"JUSTIFY\"><span style=\"font-family: Georgia, serif;\">The continued actions of the Saudi-led coalition in Yemen, including the air strikes on civilian targets with precision-guided munitions, has prompted Republicans and Democrats in Congress to keep closer watch on U.S. arms sales to Saudi Arabia and the UAE. In November 2015 the Senate Foreign Relations Committee had been able to delay the transfer of precision-guided munitions. In April 2016 Democrats and Republicans introduced joint resolutions in the <\/span><span style=\"color: #000080;\"><span lang=\"zxx\"><u><a class=\"western\" href=\"https:\/\/www.congress.gov\/bill\/114th-congress\/house-joint-resolution\/90\/titles\"><span style=\"font-family: Georgia, serif;\">House<\/span><\/a><\/u><\/span><\/span><span style=\"font-family: Georgia, serif;\"> and <\/span><span style=\"color: #000080;\"><span lang=\"zxx\"><u><a class=\"western\" href=\"https:\/\/www.congress.gov\/bill\/114th-congress\/senate-joint-resolution\/32\/titles\"><span style=\"font-family: Georgia, serif;\">Senate<\/span><\/a><\/u><\/span><\/span><span style=\"font-family: Georgia, serif;\"> to place conditions on the sale of air-to-ground munitions to Saudi Arabia. This was followed in September 2016 by two joint resolutions of disapproval, in the <\/span><span style=\"color: #000080;\"><span lang=\"zxx\"><u><a class=\"western\" href=\"https:\/\/www.congress.gov\/bill\/114th-congress\/senate-joint-resolution\/39\"><span style=\"font-family: Georgia, serif;\">Senate<\/span><\/a><\/u><\/span><\/span><span style=\"font-family: Georgia, serif;\"> and the <\/span><span style=\"color: #000080;\"><span lang=\"zxx\"><u><a class=\"western\" href=\"https:\/\/www.congress.gov\/bill\/114th-congress\/house-joint-resolution\/98\"><span style=\"font-family: Georgia, serif;\">House<\/span><\/a><\/u><\/span><\/span><span style=\"font-family: Georgia, serif;\">, for proposed sales of Abrams tanks by the Obama administration. Following the bombing of a funeral hall in October 2016, which killed over 100 civilians, the Obama administration <\/span><span style=\"color: #000080;\"><span lang=\"zxx\"><u><a class=\"western\" href=\"https:\/\/www.nytimes.com\/2016\/12\/13\/us\/politics\/saudi-arabia-arms-sale-yemen-war.html\"><span style=\"font-family: Georgia, serif;\">postponed the sale<\/span><\/a><\/u><\/span><\/span><span style=\"font-family: Georgia, serif;\"> of precision-guided munitions to Saudi Arabia in December of that year.<\/span><\/p>\n<p align=\"JUSTIFY\"><span style=\"font-family: Georgia, serif;\">In May 2017 President Trump announced that his administration would go ahead with the sale of precision-guided munitions which had been postponed by Obama. This was followed by the introduction in the Senate of a <\/span><span style=\"color: #000080;\"><span lang=\"zxx\"><u><a class=\"western\" href=\"https:\/\/www.congress.gov\/bill\/115th-congress\/senate-joint-resolution\/42\"><span style=\"font-family: Georgia, serif;\">joint resolution<\/span><\/a><\/u><\/span><\/span><span style=\"font-family: Georgia, serif;\"> relating to the disapproval of a proposed export of precision-guided munitions. Heated Congressional debates on continued U.S. support for the Saudi-led coalition continued in 2018 and 2019. CNN dropped a bombshell with a <\/span><span style=\"color: #000080;\"><span lang=\"zxx\"><u><a class=\"western\" href=\"https:\/\/edition.cnn.com\/interactive\/2019\/02\/middleeast\/yemen-lost-us-arms\/\"><span style=\"font-family: Georgia, serif;\">February 2019 report<\/span><\/a><\/u><\/span><\/span><span style=\"font-family: Georgia, serif;\"> in which they accused Saudi Arabia and the UAE of having \u201c<\/span><span style=\"font-family: Georgia, serif;\"><i>transferred American-made weapons to al Qaeda-linked fighters, hardline Salafi militias, and other factions waging war in Yemen, in violation of their agreements with the United States<\/i><\/span><span style=\"font-family: Georgia, serif;\">\u201d. The end use monitoring of U.S. supplied equipment was (briefly) discussed <\/span><span style=\"color: #000080;\"><span lang=\"zxx\"><u><a class=\"western\" href=\"https:\/\/www.govinfo.gov\/content\/pkg\/CHRG-116hhrg35360\/pdf\/CHRG-116hhrg35360.pdf\"><span style=\"font-family: Georgia, serif;\">February 6 in a hearing<\/span><\/a><\/u><\/span><\/span><span style=\"font-family: Georgia, serif;\"> before the House Foreign Affairs Committee.<\/span> <span style=\"font-family: Georgia, serif;\"><span style=\"font-size: medium;\">(2)<\/span><\/span><\/p>\n<p align=\"JUSTIFY\"><span style=\"font-family: Georgia, serif;\">In May 2019 Secretary of State Pompeo determined that an \u2018emergency\u2019 existed under Section 36 of the Arms Export Control Act (AECA). By this action he waived the congressional review requirements for <\/span><span style=\"color: #000080;\"><span lang=\"zxx\"><u><a class=\"western\" href=\"https:\/\/www.congress.gov\/congressional-record\/2019\/6\/4\/senate-section\/article\/s3203-3\"><span style=\"font-family: Georgia, serif;\">22 arms transfer cases<\/span><\/a><\/u><\/span><\/span><span style=\"font-family: Georgia, serif;\">, with a total value of $8.1 billion, to Saudi Arabia, the United Arab Emirates, and Jordan. To justify these transfers Pompeo claimed an \u2018urgent threat\u2019 from Iran. Congress was quick to react. A<\/span><span style=\"color: #000080;\"><span lang=\"zxx\"><u><a class=\"western\" href=\"https:\/\/www.defensenews.com\/congress\/2019\/06\/05\/graham-menendez-offer-action-to-thwart-trump-arms-sales-to-saudi-uae-and-jordan\/\"><span style=\"font-family: Georgia, serif;\">bipartisan<\/span><\/a><\/u><\/span><\/span><span style=\"font-family: Georgia, serif;\"> group of senators introduced \u201c<\/span><span style=\"font-family: Georgia, serif;\"><i>22 separate joint resolutions of disapproval to protect and reaffirm Congress\u2019 role in approving arms sales to foreign governments<\/i><\/span><span style=\"font-family: Georgia, serif;\">\u201d<\/span> <span style=\"font-family: Georgia, serif;\"><span style=\"font-size: medium;\">(3)<\/span><\/span><span style=\"font-family: Georgia, serif;\">. Only three of these joint resolutions (S.J.Res.36, S.J.Res.37 and S.J.Res.38) passed the Senate and the House, but were vetoed by President Trump.<\/span><\/p>\n<p align=\"JUSTIFY\"><span style=\"font-family: Georgia, serif;\">The \u2018emergency\u2019 declaration was <\/span><span style=\"color: #000080;\"><span lang=\"zxx\"><u><a class=\"western\" href=\"https:\/\/www.reuters.com\/article\/us-usa-saudi-arms\/republican-democratic-senators-seek-to-block-trump-saudi-arms-sales-idUSKCN1T61PL\"><span style=\"font-family: Georgia, serif;\">questioned by members<\/span><\/a><\/u><\/span><\/span><span style=\"font-family: Georgia, serif;\"> of both parties in Congress \u201c<\/span><span style=\"font-family: Georgia, serif;\"><i>who worried that Trump\u2019s decision to blow through the review process would eliminate Congress\u2019 ability to<\/i><\/span> <span style=\"font-family: Georgia, serif;\"><i>prevent not just Trump but future presidents from selling weapons where they liked<\/i><\/span><span style=\"font-family: Georgia, serif;\">\u201d. In June 2019 the House Committee on Foreign Affairs convened a hearing titled \u201c<\/span><span style=\"font-family: Georgia, serif;\"><i>What Emergency?: Arms Sales and the Administration&#8217;s Dubious End-Run Around Congress<\/i><\/span><span style=\"font-family: Georgia, serif;\">\u201d (Serial No. 116-46) to discuss the matter. A Congressional insider told <\/span><span style=\"color: #000080;\"><span lang=\"zxx\"><u><a class=\"western\" href=\"https:\/\/www.politico.com\/news\/2020\/08\/11\/state-department-civilians-middle-east-393584\"><span style=\"font-family: Georgia, serif;\">Politico<\/span><\/a><\/u><\/span><\/span><span style=\"font-family: Georgia, serif;\"> that &#8220;<\/span><span style=\"font-family: Georgia, serif;\"><i>the concern all along was that Pompeo concocted the emergency to bypass Congress. A few key details in the <\/i><\/span><span style=\"font-family: Georgia, serif;\"><i>[OIG] <\/i><\/span><span style=\"font-family: Georgia, serif;\"><i>report verify that, and those are the details State tried to bury. It looks like a coverup<\/i><\/span><span style=\"font-family: Georgia, serif;\">\u201d. Even the conservative <\/span><span style=\"color: #000080;\"><span lang=\"zxx\"><u><a class=\"western\" href=\"https:\/\/nationalinterest.org\/blog\/paul-pillar\/trumps-middle-east-folly-arms-saudis-and-how-inspectors-general-get-spun-167029\"><span style=\"font-family: Georgia, serif;\">National Interest<\/span><\/a><\/u><\/span><\/span><span style=\"font-family: Georgia, serif;\"> was not convinced of ,<\/span><span style=\"font-size: xx-small;\"><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: medium;\">the<\/span><\/span><\/span> <span style=\"font-family: Georgia, serif;\">nature of the \u2018emergency\u2019: \u201c<\/span><span style=\"font-family: Georgia, serif;\"><i>The procedural timeline described in the IG report belies the notion that the arms transfer involved was a matter of urgency. The use of an emergency exception was first proposed inside the [State] Department on April 3. The emergency certification was drafted on April 23. The certification was transmitted to Congress on May 24. Some entire wars have been fought during that much time<\/i><\/span><span style=\"font-family: Georgia, serif;\">\u201d. The <\/span><span style=\"color: #000080;\"><span lang=\"zxx\"><u><a class=\"western\" href=\"https:\/\/www.stateoig.gov\/reports\/10715\"><span style=\"font-family: Georgia, serif;\">OIG<\/span><\/a><\/u><\/span><\/span><span style=\"font-family: Georgia, serif;\"> did not assess if a true \u2018emergency\u2019 existed. They only \u201c<\/span><span style=\"font-family: Georgia, serif;\"><i>determined that the Secretary\u2019s emergency certification was executed in accordance with the requirements of the AECA<\/i><\/span><span style=\"font-family: Georgia, serif;\">\u201d.<\/span><\/p>\n<p align=\"JUSTIFY\"><span style=\"font-family: Georgia, serif;\">The OIG report was released by the acting Inspector General because Steve Linick, the Inspector General who initiated the investigation, had been fired by the Secretary of State Pompeo. Linick was also responsible for an ongoing investigation into the misappropriation of State Department funds by Pompeo and his wife for personal reasons. Linick was replaced by Stephen Akard, an ally of Vice President Mike Pence.
