{"id":14096,"date":"2020-07-13T13:37:39","date_gmt":"2020-07-13T11:37:39","guid":{"rendered":"https:\/\/ipisresearch.be\/\/publication\/arms-trade-bulletin-may-june-2020\/"},"modified":"2020-09-01T09:03:57","modified_gmt":"2020-09-01T07:03:57","slug":"arms-trade-bulletin-may-june-2020","status":"publish","type":"weekly-briefing","link":"https:\/\/ipisresearch.be\/fr\/weekly-briefing\/arms-trade-bulletin-may-june-2020\/","title":{"rendered":"Arms Trade Bulletin May \u2013 June 2020"},"content":{"rendered":"<h1>LES TRANSFERTS D&rsquo;ARMES \u00c0 L&rsquo;\u00c9PREUVE DE LA JUSTICE ET DU COVID-19<\/h1>\n<p>&nbsp;<\/p>\n<p style=\"text-align: justify;\">La premi\u00e8re partie de l\u2019ann\u00e9e 2020 a \u00e9t\u00e9 \u00e9difiante en France tant sur le plan des d\u00e9cisions de justice sur les autorisations d\u2019exportations d\u2019armes, que sur le principe de lier la puissance d\u2019un \u00c9tat \u00e0 la force militaire \u2013 \u00e0 la fois son budget militaire, son potentiel technologique militaire et sa capacit\u00e9 de produire et vendre des armes.<\/p>\n<p style=\"text-align: justify;\"><a href=\"https:\/\/aser-asso.org\/\">Action S\u00e9curit\u00e9 \u00c9thique R\u00e9publicaines<\/a> (ASER), rejoint par six autres ONG, a d\u00e9pos\u00e9 le 6 f\u00e9vrier 2020 une requ\u00eate et m\u00e9moire en r\u00e9f\u00e9r\u00e9 libert\u00e9 devant le tribunal administratif de Paris afin d\u2019annuler \u00ab les autorisations de transit de mat\u00e9riel de guerre (ATMG) et les autorisations de sortie douani\u00e8res de mat\u00e9riel de guerre vers le cargo \u00abBAHRI YANBU\u00bb \u00e0 partir du port de CHERBOURG \u00e0 destination de l\u2019Arabie saoudite. Si notre demande a \u00e9t\u00e9 rejet\u00e9e et les 18 v\u00e9hicules blind\u00e9s l\u00e9gers ARQUUS malheureusement charg\u00e9s dans le cargo, la juge des r\u00e9f\u00e9r\u00e9s nous reconnait le droit \u00e0 agir en justice et note \u00ab\u00a0qu\u2019un lien existe entre de telles autorisations et les souffrances de la population y\u00e9m\u00e9nite\u00bb. Cette r\u00e9f\u00e9rence aux buts du trait\u00e9 sur le commerce des armes (TCA) des Nations Unies, pr\u00e9cis\u00e9s dans son article premier, est une premi\u00e8re pour la justice fran\u00e7aise. Cette r\u00e9daction laisse entendre que le gouvernement fran\u00e7ais, en autorisant des exportations d\u2019armes en direction de la coalition, viole les buts du TCA. Ce point est d\u2019autant plus important que l\u2019ordonnance est envoy\u00e9e \u00e0 tous les minist\u00e8res pr\u00e9sents au sein de la <a href=\"http:\/\/www.sgdsn.gouv.fr\/missions\/controler-les-exportations-de-materiel-de-guerre\/\">Commission interminist\u00e9rielle pour l\u2019\u00e9tude des exportations de mat\u00e9riels de guerre<\/a>\u00a0en charge des d\u00e9cisions d\u2019exportations d\u2019armes. En d\u2019autres termes, tous les fonctionnaires ont maintenant connaissance du risque d\u2019ill\u00e9galit\u00e9 de leurs d\u00e9cisions d\u2019exportations vers les pays de la coalition dirig\u00e9e par l\u2019Arabie saoudite et les \u00c9mirats arabes unis dans la guerre au Y\u00e9men.<\/p>\n<p style=\"text-align: justify;\">Le coronavirus aura quant \u00e0 lui eu raison des transferts d\u2019armes de la France, \u00e0 l\u2019arr\u00eat d\u2019apr\u00e8s nos informations durant la crise en raison principalement du manque de main d\u2019\u0153uvre, les douanier\u00b7es en l\u2019occurence. Plus surprenant encore, le gouvernement fran\u00e7ais n\u2019a pas jug\u00e9 bon de r\u00e9quisitionner la douane pour assurer ces transferts qu\u2019il disait vitaux pour le partenariat strat\u00e9gique de la France. Les exportations d\u2019armes peuvent donc bien \u00eatre ralenties et m\u00eame bloqu\u00e9es sans que cela ne bouleverse ou n\u2019aggrave les conflits \u00e0 travers la plan\u00e8te prouvant ainsi qu\u2019une mise en \u0153uvre rigoureuse du TCA est non seulement possible mais r\u00e9aliste.<\/p>\n<p style=\"text-align: justify;\">La crise du Coronavirus presque plan\u00e9taire n\u2019a pas \u00e9pargn\u00e9 les pays dont la puissance se confondait avec la force militaire (1). La liste des premiers pays en termes de d\u00e9penses militaires (2) ainsi que celle des principaux producteurs d\u2019armes est presque\u00a0similaire \u00e0 celle des pays les plus touch\u00e9s par la pand\u00e9mie : l\u2019Afrique du sud, l\u2019Alg\u00e9rie, l\u2019Arabie saoudite, la Belgique, le Br\u00e9sil, la Chine, l\u2019Allemagne, l\u2019Espagne, les \u00c9tats-Unis, la France, la Grande Bretagne, l\u2019Inde, Isra\u00ebl (3), l\u2019Italie, le Japon, la Russie, la Su\u00e8de, la Turquie (4)\u2026<\/p>\n<p style=\"text-align: justify;\">Un bilan sans appel et riche d\u2019enseignements.<\/p>\n<p style=\"text-align: justify;\">La crise du coronavirus pourrait marquer la fin d\u2019un fourvoiement\u00a0: la puissance d\u2019un pays ne se mesure pas \u00e0 sa capacit\u00e9 militaire mais plut\u00f4t \u00e0 son aptitude \u00e0 mettre en \u0153uvre des droits de l\u2019Homme, dont les droits \u00e9conomiques sociaux et culturels.
