Identifying, preventing, and mitigating risks of adverse impact can be concretised through&nbsp;<strong>human rights due diligence.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Because arms transfers are&nbsp;closely linked to the states\u2019 geopolitical interests and defence policy objectives, they are highly regulated and subjected to a strict&nbsp;<strong>export<\/strong>&nbsp;<strong>licencing process<\/strong>. States must ensure<strong>&nbsp;<\/strong>that these licences are only granted after conducting an impact assessment of the activities involved and as a result, corporate accountability has somehow gone unnoticed.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The international legal framework includes several mandatory and non-binding instruments that require&nbsp;<strong>states&nbsp;<\/strong>to regulate arms value chains. The main questions are:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>To what extent are the companies active in the arms value chains required to incorporate into their risk assessments, the adverse and salient human rights impacts that their activities or the misuse of their products may cause or contribute to?&nbsp;<\/li>\n\n\n\n<li>To what extent should the duty of conducting such risk assessments to obtain export licences entail the obligation to implement due diligence procedures?<\/li>\n<\/ul>\n\n\n\n<div style=\"height:10px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<figure class=\"wp-block-image alignleft size-full is-resized\"><a href=\"https:\/\/ipisresearch.be\/wp-content\/uploads\/2024\/03\/Focus-of-the-study-downstream-value-chain.png\"><img decoding=\"async\" width=\"781\" height=\"178\" src=\"https:\/\/ipisresearch.be\/wp-content\/uploads\/2024\/03\/Focus-of-the-study-downstream-value-chain.png\" alt=\"\" class=\"wp-image-34707\" style=\"width:509px;height:auto\" srcset=\"https:\/\/ipisresearch.be\/wp-content\/uploads\/2024\/03\/Focus-of-the-study-downstream-value-chain.png 781w, https:\/\/ipisresearch.be\/wp-content\/uploads\/2024\/03\/Focus-of-the-study-downstream-value-chain-300x68.png 300w, https:\/\/ipisresearch.be\/wp-content\/uploads\/2024\/03\/Focus-of-the-study-downstream-value-chain-768x175.png 768w\" sizes=\"(max-width: 781px) 100vw, 781px\" \/><\/a><\/figure>\n<\/div>\n<\/div>\n\n\n\n<p class=\"wp-block-paragraph\">The analysis defends the notion of&nbsp;<strong>shared responsibility<\/strong>&nbsp;of both states and companies&nbsp;which implies that corporate actors do not merely play a subordinate role but act on an equal footing with states, implementing their own due diligence processes. States and companies active in arms value chains&nbsp;have then a shared responsibility to&nbsp;prevent and remedy the misuse of transferred arms, and serious breaches of international human rights and humanitarian law.&nbsp;The next step would be to require&nbsp;<strong>due diligence for all the activities<\/strong>&nbsp;of a corporate group or a value chain,&nbsp;<strong>and not only for licencing purposes<\/strong>. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Finally, the study stresses that responsible corporate behaviour also implies&nbsp;<strong>engagement with stakeholders<\/strong> and representatives of civil society.
