Also known as the&nbsp;\u201cConflict Minerals\u201d or \u201cResponsible Minerals\u201d Regulation, it&nbsp;aims to break the link between the exploitation and trade in 3TG on the one hand, and conflict financing on the other hand. The law also aims to support the development of local communities.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Regulation is largely based on the&nbsp;Organisation for Economic Co-operation and Development&rsquo;s&nbsp;<strong>(OECD)&nbsp;<\/strong><strong>Due Diligence Guidance<\/strong>&nbsp;for Responsible Supply Chains of Minerals from CAHRAs, the leading norm for responsible mineral sourcing.&nbsp;Its innovation lies in the fact that the Regulation makes the otherwise voluntary Guidance&nbsp;<strong>mandatory for EU importers<\/strong>.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This <strong><a href=\"https:\/\/ipisresearch.be\/\/wp-content\/uploads\/2023\/10\/20231019_IPIS-The-EU-conflict-minerals-regulation_High-stakes-disappointing-results.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">briefing paper<\/a> <\/strong>seeks to evaluate how the Regulation has actually played out and what the main obstacles to its effective implementation have been so far. The paper is&nbsp;<strong>based on an analysis of documents and interviews with stakeholders, including regulators, industry representatives, and civil society.&nbsp;<\/strong><\/p>\n\n\n\n<div class=\"wp-block-columns is-layout-flex wp-container-core-columns-is-layout-7387b849 wp-block-columns-is-layout-flex\">\n<div class=\"wp-block-column is-layout-flow wp-block-column-is-layout-flow\" style=\"flex-basis:33.33%\">\n<figure class=\"wp-block-image size-large is-resized\"><a href=\"https:\/\/ipisresearch.be\/\/wp-content\/uploads\/2023\/10\/20231019_IPIS-The-EU-conflict-minerals-regulation_High-stakes-disappointing-results.pdf\" target=\"_blank\" rel=\"noopener\"><img decoding=\"async\" src=\"https:\/\/ipisresearch.be\/\/wp-content\/uploads\/2023\/10\/EU-Conflicts-minerals-regulation_cover-1-724x1024.png\" alt=\"\" class=\"wp-image-30159\" style=\"aspect-ratio:0.7080078125;width:363px;height:auto\"\/><\/a><\/figure>\n\n\n\n<div class=\"wp-block-buttons is-content-justification-center is-layout-flex wp-container-core-buttons-is-layout-3e41869c wp-block-buttons-is-layout-flex\">\n<div class=\"wp-block-button\"><a class=\"wp-block-button__link has-black-color has-text-color has-background has-link-color wp-element-button\" href=\"https:\/\/ipisresearch.be\/\/wp-content\/uploads\/2023\/10\/20231019_IPIS-The-EU-conflict-minerals-regulation_High-stakes-disappointing-results.pdf\" style=\"background-color:#fa784a\" target=\"_blank\" rel=\"noreferrer noopener\">Download the report<\/a><\/div>\n<\/div>\n<\/div>\n\n\n\n<div class=\"wp-block-column is-layout-flow wp-block-column-is-layout-flow\" style=\"flex-basis:66.66%\">\n<p class=\"wp-block-paragraph\">Disappointingly, more than six years after the Regulation was signed into law, and almost three years after the requirements for EU importers started applying, our overall assessment is that&nbsp;<strong>the Regulation has not achieved any notable impact along supply chains, let alone in producing countries.&nbsp;<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The lack of impact can be explained at several levels. Firstly,&nbsp;<strong>Member States\u2019 Competent Authorities<\/strong> (MSCAs), which are responsible for ensuring the \u201ceffective and uniform\u201d implementation of the Regulation,&nbsp;<strong>often lack the necessary sector expertise and capacity to fulfill their task<\/strong>. Moreover, differences between the interpretation by MSCAs of the Regulation have resulted in an uneven implementation across Member States.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Secondly, many EU importers of 3TG have not (yet) sufficiently complied with the Regulation\u2019s requirements.&nbsp;<strong>EU importers often fail to operate&nbsp;adequate and complete supply chain traceability systems<\/strong>, and to disclose relevant information, which has prevented transparency to increase.&nbsp;Most Union importers source from smelters and refiners outside the EU which, in their turn, are often not fully transparent on mineral origin.&nbsp;Because the mine of mineral origin is often not known to Union importers, we fear that EU obligations rarely cascade to suppliers up to the level of producing countries.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><\/p>\n<\/div>\n<\/div>\n\n\n\n<p class=\"wp-block-paragraph\">If the EU aims for the Conflict Minerals Regulation to contribute to an improved human rights situation in producing countries, including in CAHRAs, it has to actively intervene, both by&nbsp;<strong>encouraging downstream companies to engage in CAHRAs&nbsp;and in the artisanal and small-scale mining sectors<\/strong>&nbsp;and by&nbsp;<strong>supporting upstream producers to progressively meet the EU standards<\/strong>. This progressive approach, that accepts imperfection, would at the same time stimulate more transparency.&nbsp;<\/p>\n\n\n\n<div style=\"height:20px\" aria-hidden=\"true\"
